Low Rise Medium Density Housing Code and Tweed Local Environmental Plan 2014 Amendment No.26

The NSW Government is introducing new planning controls through a Low Rise Medium Density (LRMD) housing code that will allow one and two storey dual occupancies, manor houses and terraces to be built under a fast track complying development approval.

This approval could be issued within 20 days if the application complies with all the relevant requirements in the Code, providing little opportunity for the community to have their say.

The new Code will come into effect on 31 October 2019 and will apply to residential zones and the village zone in certain circumstances.


What is being proposed by Council?

In reply to the new Code, Council has endorsed the exhibition of a draft amendment to the Tweed Local Environmental Plan 2014 (the LEP) which is explained in the planning proposal now on exhibition.

The draft amendment seeks to:

  • maintain the current minimum lot size and density controls in the R2 Low Density Residential zone and the RU5 Village zone, and
  • ensure the low density character of those areas is retained.

In addition, the draft amendment also seeks to incorporate building heights for the new town centre in Area ‘E’. Area E is a proposed residential area at Terranora which has been master planned and endorsed by Council.
